The High Court's Chamber concluded that the facts described in the complaint do not constitute any crime, thus ordering the dismissal of the case. The accusation focused on the alleged leaking to the media of messages sent by a former councilwoman from Móstoles to the regional leader's inner circle.
These emails, which expressed complaints about an alleged case of harassment or sexual assault attributed to Móstoles mayor, Manuel Bautista, reportedly received no response within the Popular Party of Madrid, leading the councilwoman to resign. Subsequently, parts of these communications were published by various media outlets.
The magistrates consider that the document lacks concrete facts that could fit the invoked criminal type and emphasize the absence of probative elements that justify the opening of an investigation.
The Supreme Court has supported the position of the Prosecutor's Office, which had already opposed the admission of the complaint. The magistrates indicated that the document lacks the necessary specificity to fit a criminal offense and that there is insufficient evidence to justify an investigation.
Furthermore, the ruling highlights that the complaint is primarily based on journalistic reports, a foundation that the court deems insufficient to initiate proceedings, as it would imply a merely prospective investigation. With this decision, the Supreme Court closes the criminal proceedings in this matter, finding no evidence of a crime.
