The Legal Advisory Commission of the Community of Madrid issued a favorable opinion on August 25, 2026, supporting the San Martín de la Vega City Council's decision to terminate the contract for the renovation of the “Glorieta San Marcos” park. The termination follows the abandonment of the work by the awarded contractor, INSTALACIONES MADRILEÑAS SECIS, S.L.
The body concluded that "it is unequivocally proven that the contractor not only delayed in meeting deadlines but also abandoned the work, all of which is confirmed by the site visit reports from May 2026 and the contractor's own statements".
The Mayor, Rafael Martínez, highlighted that the Legal Commission's opinion is mandatory under the Public Sector Contracts Law and a prerequisite for the City Council's final resolution. This will allow the current process to be concluded and a new one initiated with a revised project to resume the park's works as soon as possible. Martínez stated that "throughout the entire procedure, we have acted correctly and demanded contractual obligations that have clearly been breached".
The Commission also addressed compensation for damages and losses, noting that "when the contract termination is due to the contractor's culpable breach, they must compensate for the damages and losses caused, with compensation being applied, in the first instance, against the guarantee". Therefore, the City Council announced that, in addition to the termination, the retention of the guarantee deposited by the contractor will be considered, without prejudice to a separate adversarial procedure to determine the damages caused to the municipality and its residents by the work abandonment.
The Mayor concluded by stating that "we will spare no effort in adopting all necessary measures to claim the damages we have suffered" and that "we will continue working to ensure the completion of this important project for the improvement of the urban environment".
