The officer, who until now was listed as a witness, is scheduled to appear on June 9. This judicial decision follows a request from the private prosecution, which sought his implication based on autopsy results.
The incident occurred on June 17, 2025, when a young man, approximately 35 years old, died after being restrained by two off-duty Madrid municipal police officers. The investigation suggests the deceased had attempted to steal one of the officers' mobile phones.
The forensic report concluded that the death was caused by anoxia due to asphyxiation during the immobilization. The forensic experts indicated thoracic compression, a neck hold, and the prone position in which he was restrained as possible causes.
The judge deems the testimony of the investigated officer's colleague "appropriate and necessary" to clarify his potential degree of involvement in the events. Furthermore, she rejected a defense request to access the deceased's complete medical history, stating that the expert report will be based on the medical and toxicological documentation already included in the proceedings.
