The controversy stems from a legal report issued by the Community of Madrid, which the Popular Party of Alcorcón uses to argue for the nullity of the private security contract awarded for the 2025 festivities. The political group has asked the council to clarify the situation, while the local government maintains that the same document supports their actions.
“"We will not allow this way of acting through a contract awarded by hand, declared illegal by the Community of Madrid itself, and which they now intend to pay without anyone explaining who made that decision."
The Popular Party has urged the local Executive to identify the political or technical officials who authorized the contracting of the service, alleging that it was not an administrative error but a reckless management of public funds. They emphasize that the concern is not the need for security, but the manner in which the process was carried out, demanding transparency and the proper use of resources.
According to the Popular Party's interpretation, the report details that, after the initial procedure was declared void, the City Council verbally resorted to the same company previously rejected. They highlight that verbal contracting is prohibited and that the facts constitute a radical nullity, concluding that there was no emergency situation and that the lack of planning is attributable to the City Council itself.
For its part, the local government insists that the process complied with the Public Sector Contracts Law. They explain that, upon detecting that the company was not up to date with its tax and Social Security obligations, measures were taken to annul the procedure due to the company's lack of diligence. They affirm that the legal report from the Community of Madrid supports their position, as it was the City Council itself that initiated the file upon detecting the irregularity.
The Consistory has detailed that two tenders were carried out with all legal guarantees, including a responsible declaration from the company assuring compliance with requirements. Upon verifying the falsity of this declaration, the nullity procedure was initiated in the Local Government Board, with the aim of paying the salaries of the workers who provided the service and applying a sanction to the company. The amount to be paid will be limited to the service actually rendered.
