The Official Gazette of the Community of Madrid (BOCM) has detailed regulations that seek to balance the fundamental right to strike for workers with the need for families to reconcile work and family life, and the right to education for minors. The sector faces two simultaneous strike calls that will affect centers in the region.
On one hand, UGT Servicios Públicos de Madrid has called a 24-hour strike, from 00:00 to 24:00 on Tuesday, April 7, 2026, targeting all personnel covered by the XIII Early Childhood Education Agreement. In this instance, the administration and the union reached an agreement on minimum services after a meeting held on March 24.
In contrast, CGT Madrid has announced an indefinite strike also starting on Tuesday, April 7, 2026, at 00:00. Unlike the previous call, no consensus was reached between the parties after the meeting on March 25, leading the Ministry of Education, Science and Universities to unilaterally impose minimum services.
Education is an «essential service» and that the closure of centers for minors would directly affect the freedom of parents or guardians to go to their workplaces.
The minimum services established by the Ministry, led by Mercedes Zarzalejo, are identical for both calls and aim to guarantee the opening and safety of the centers. They include the mandatory presence of the director to ensure opening and remaining on the premises, as well as specific staff ratios: one professional for every 12 children under one year old, one for every 18 children aged one to two years, and one for every 24 children aged two to three years. Additionally, the maintenance of food and cleaning services must be ensured during the strike hours.
The administration justifies these measures by emphasizing the essential nature of educational services and the protection of students, especially those with special educational needs. Non-compliance with these minimum services, which will be nominatively determined by each center's management, may result in sanctions according to current regulations. The orders came into effect on Monday, April 6, 2026, following their official publication.
