Three defendants sentenced to 35 years in prison for murder in Alcorcón

The Provincial Court of Madrid has sentenced three individuals to 35 years in prison each for their involvement in a murder that occurred in October 2022 in Alcorcón.

The ruling finds the defendants responsible for a completed murder offense, two attempted murder offenses, and illegal possession of a firearm. The sentences total 16 years for the main murder, 9 years for each attempted murder, and an additional year for the weapon.
According to the judgment, the three defendants acted jointly after a prior altercation at a nightclub. They later traveled by vehicle to the vicinity of a residence in Alcorcón where the victims were located. A pursuit and several shots were fired there.
One of the bullets injured one of the victims in the shoulder, and a second shot to the head caused their death. The other two individuals managed to escape unharmed despite the shots fired in their direction.
The court bases its decision on evidence presented during the trial, including witness statements, expert reports, DNA analysis, ballistics tests, and phone positioning data, which helped reconstruct the events and place the defendants at the scene and time of the crime.
The sentence classifies the events as murder with treachery (alevosía), as the victims were unarmed and attacked while attempting to flee, limiting their ability to defend themselves. The court also established the illegal possession of the weapon used.
However, the mitigating circumstance of undue delay has been applied due to the accumulated delay in holding the trial, which extended for nearly a year due to reasons beyond the defendants' control.
