Court Annuls Procedure Change in Parla's PAU-5 Development

Judicial decision halts forced expropriation of land in the large business development area of the Madrid town.

The Contentious-Administrative Court number 9 of Madrid has granted the precautionary measures requested by the PAU-5 Compensation Board of Parla, annulling the local government's agreements that ratified the change to forced expropriation.

This ruling represents a new judicial setback for Ramón Jurado's local government, following a previous ruling by the Contentious-Administrative Court number 5 in January, which had already suspended the procedure change. The current decision effectively halts the modification of the system for the development of this land, pending a final judgment.

It is appropriate to grant the requested precautionary measure, such that I order the suspension of the second and third agreements of the Government Board's resolution of January 16, 2026, until a final resolution is issued on the merits.

The points annulled by the court refer to the «dissolution and liquidation» of the Compensation Board and the City Council's justification for endorsing the shift from compensation to expropriation. The Urban Planning department had argued that 58.89% of the owners, representing 1,083,827 m² (53.7386% of the affected land), agreed with the system change and had formalized adhesions to the expropriation framework.
The court has upheld the precautionary measure requested by the plaintiffs, who argued that continuing the expropriation process would cause them «serious financial harm». According to the plaintiffs, proceeding with the expropriation without a legal budget and liquidating the Compensation Board would circumvent the effectiveness of previous judicial rulings.
The matter was discussed in last Thursday's Plenary Session, where opposition groups questioned Mayor Ramón Jurado (PSOE) about his knowledge of the order. The mayor confirmed he was aware but declined to offer explanations at that time, inviting interested parties to his office. Vox spokesperson, Juan Marcos Manrique, criticized the mayor's actions, stating that he had attempted to impose an expropriation model «overriding residents, legality, and common sense».
