The plea agreement, reached before the trial at the Provincial Court of Madrid, significantly reduces the initial request from the Public Prosecutor's Office, which had sought 15 years and nine months in jail for attempted murder and domestic injury.
In addition to the prison sentence, the accused has accepted a nine-year ban on approaching or communicating with the victim, five years of supervised release, and must pay 14,000 euros in compensation.
The sentence reduction is due to the defendant's acknowledgment of the facts and the application of a highly qualified mitigating factor for reparation of damage. The man had been in provisional detention for approximately two years.
The act of violence occurred on the night of September 4, 2024, when the accused arrived drunk at the home he shared with the woman. Upon entering, he discovered she had packed her bags to leave the residence.
According to the prosecution's account, the defendant was in a romantic relationship with the victim, living together in a context allegedly characterized by domination and contempt towards her "because of her gender".
The accused did not accept the woman's decision to end the relationship. Upon arriving at the home around midnight and seeing the victim preparing to leave, he initiated a physical assault against her.
According to the prosecution, the man even attempted to strangle her with his hands before briefly leaving the residence. He returned later with a red gasoline can, which he placed on the living room sofa, and proceeded to hit the woman again in the face and head while she pleaded with him to stop.
The defendant subsequently forced the victim to stand up and doused her with gasoline while threatening to kill her. "Everything is going to end today, I'm going to kill you," he reportedly said as he led her towards the kitchen.
The woman managed to escape by taking advantage of a moment of distraction from the aggressor and ran out of the building, pursued by the accused until they reached the local police station in Villanueva del Pardillo, where the man stopped chasing her.
Following the incident, the defendant disposed of the gasoline can by throwing it into a dumpster near the residence.
The victim's injuries included bruising to the cervical and facial areas, which took 20 days to heal, ten of which prevented her from carrying out her daily activities.
Before the agreement, the prosecution classified the events as constituting attempted murder and domestic injury, with aggravating factors of kinship and gender.
For these offenses, the Public Prosecutor's Office initially sought 14 years and nine months in prison for attempted murder and an additional year for the injuries, along with eight years of supervised release and restraining orders prohibiting contact with the victim.
Regarding civil liability, the prosecution requested that the accused compensate the woman with 1,500 euros for her injuries and an additional 20,000 euros for moral damages.
