This decision comes after the Supreme Court (TS) rejected an appeal filed by the Madrid City Council against the ruling that invalidated the municipal ordinance articles defining the scope of the capital's ZBEs. Despite this judicial setback, the municipal government maintains that the annulment of the ruling is ineffective, as a new Mobility ordinance was approved in March.

In response to this situation, a spokesperson for a political party in the City Council has announced that they will present a motion in the upcoming Cibeles Plenary Session to demand the mayor refund the fines. However, the Deputy Mayor has reiterated the council's stance, based on the non-retroactivity of the rulings.
It is worth noting that in 2024, the City Council had already expressed its intention to appeal to the Supreme Court against the ruling by the Superior Court of Justice of Madrid (TSJM) that annulled the capital's Low Emission Zones.
