This judicial decision, first reported by ‘Cadena Ser’, rejects the petition from the companies Maxwell Cremona Ingeniería y Procesos Sociedad para el Fomento del Medioambiente S.L. and Masterman&Whitaker, as well as from Alberto González Amador. The appeal was lodged against a ruling by Instruction Court number 19 of Madrid, issued in July 2025, which authorized the UCO investigation.
The investigation primarily focuses on the sale and purchase of the company Círculo de Belleza S.L., which was acquired in 2020 by a company linked to González Amador for approximately 500,000 euros.
The court has rejected the appellants' request to dismiss the proceedings, where they argued that no crime had been committed. The Court concluded that the appeal must be dismissed, thus supporting the actions of the Instruction Court.
The procedure originated from a resolution in June 2025, where the court tasked the UCO with investigating the facts. This decision was appealed by the defense of González Amador and the involved companies. However, the Provincial Court considers this measure to be part of the investigative proceedings and, therefore, not subject to appeal at this stage. Furthermore, it highlighted that the request for dismissal had not been previously resolved by the instructing court, preventing its analysis at this point.
Consequently, the court has fully upheld the contested resolution, allowing the investigation to proceed without imposing costs on the parties, as no bad faith was observed in the process.
