This decision is based on the fact that the Supreme Court's partial annulment of the Mobility Ordinance does not directly impact the general ZBE across the entire municipality. This stance was communicated by Madrid's deputy mayor, who cited jurisprudence supporting the non-retroactivity of court rulings, beyond any appeals that may be filed.

However, the situation differs for fines in the ZBEs of Plaza Elíptica and Centro. Sources from the Mobility department have indicated that the City Council has not yet decided what to do with sanctions imposed in these specific areas since December 17, 2024, the date of the first ruling by the Superior Court of Justice of Madrid (TSJM).
Although the municipal government had previously stated that the ruling was rendered ineffective after the new Mobility Ordinance was approved in March, uncertainty persists for these specific zones. In response, the spokesperson for Vox in the City Council has announced plans to present a motion at the upcoming Cibeles Plenary Session, demanding that the mayor refund the fines.
