Madrid City Council has announced its intention to file an appeal before the Supreme Court against the ruling that annuls the 2025 waste fee, based on the advice of its legal services.
The decision was communicated during the Cibeles Plenary Session, where it was explained that the action is taken due to the existence of legal grounds to challenge the annulment. This step follows the recommendation of municipal legal services, who have assessed the situation and determined the viability of the appeal.
“
"We ask the legal services: are there grounds or not? And the legal service tells us there are grounds, and therefore, we will file an appeal against this fiscal ordinance."
The ruling by the Superior Court of Justice of Madrid (TSJM) that annulled the 2025 waste fee was based on a "strictly formal reason" related to a lack of documentation during its processing. Regarding the potential refund of already collected funds, the City Council has indicated that it will act in accordance with the law and the judgment itself.
“
"You should know that the law sets limits for the refund of money when it comes to the annulment of general provisions, or at least you should know that when administrative acts are final, no refund is possible."
Meanwhile, the opposition has criticized the decision. The deputy spokesperson for the Socialist Municipal Group stated that appealing the ruling only "prolongs the agony" of Madrid residents, questioning the City Council's consistency in following legal recommendations based on political convenience.
“
"It is not true that the City Council appeals based on what legal advice says. It depends. Sometimes it does, and sometimes it doesn't. The only thing they have in common is that they always harm the people of Madrid."
