The decision to dissolve the jury was made after one of the defendants failed to appear, leading to suspicions that they might have left Spain. The events date back to July 25, 2021, when the two accused engaged in an illegal race through the tunnels of the M-30 ring road. During this incident, one of the vehicles collided with another, whose driver died hours later at the 12 de Octubre Hospital.
The Public Prosecutor's Office is seeking 15-year prison sentences for each of the individuals involved, for homicide and reckless driving. Meanwhile, the defense of the fugitive accused claims they acted under insurmountable fear, asserting they were being pursued by the other driver with no possibility of leaving the road.
“"It is not possible to proceed without fully guaranteeing the rights of both parties. The statements of the accused were missing, which are fundamental for contrasting versions in a case where the conduct of both is closely linked, making it difficult to reach a verdict."
The oral hearing, which was scheduled to resume this Thursday, has been definitively suspended. The defendant's failure to appear made it unfeasible to continue the process under current conditions, leading to the jury's dissolution. Last week, a search and arrest warrant had already been issued for the absent accused, but the Civil Guard was unsuccessful in locating them.
Testimonial and expert evidence concluded on April 14, and the defendants' appearances before the jury were scheduled for the following day, which is when one of them was absent. Both the defenses and the Prosecutor's Office had previously agreed to postpone the hearing or dissolve the jury if the accused did not appear, a scenario that has now materialized.
Among the highlighted evidence are recordings from M-30 cameras, which reportedly show speeds of up to 176 kilometers per hour in a section limited to 70. However, the defenses have questioned the reliability of these measurements, as they were obtained through image analysis rather than officially approved radars.
