The Ombudsman, Ángel Gabilondo, has expressed his respect for the decision made by the Plenary of the Constitutional Court (TC) regarding the suspension of voting rights for individuals naturalized under the Democratic Memory Law, voicing concern for Spanish citizens who might be unable to exercise this fundamental right.

The institution filed an appeal for protection with the TC last Friday, requesting urgent interim measures to safeguard fundamental rights such as voting and equality. The Ombudsman acted upon receiving requests from individuals and entities seeking to prevent those affected from being barred from exercising their right to vote.
In the appeal, the Ombudsman noted that the orders from the Contentious-Administrative Chamber of the Supreme Court (TS), confirmed on October 12, are final and have irreversible practical effects for many people, given the current tight electoral deadlines. Therefore, a swift ruling from the TC was requested.
Ángel Gabilondo based his action on the constitutional prerogative (Article 162.1b) and Organic Law 3/1981, which empower the Ombudsman to defend the fundamental rights enshrined in Title I of the Constitution.
