The judicial decision, accessed by Europa Press, rejects an appeal filed by the mayor against a previous resolution from February 16 that had already agreed to extend the investigation. The court downplayed the fact that the extension was requested by the prosecution, arguing that the law allows it to be granted either ex officio or at the request of the parties.
The magistrate considers the extension justified, explaining that the “continuous requests for suspension and postponement of proceedings” by the defense have hindered the progress of the case within the initial twelve-month period. For now, the dismissal of the procedure is ruled out, as there are indications derived from the practiced diligences that justify its continuation.

The case originated in early 2024, when Mayor Judith Piquet publicly mentioned the existence of two sexual assault complaints without an identified perpetrator, describing the alleged responsible party as “a young black male.” Subsequently, the general secretary of the PP of Madrid, Alfonso Serrano, disseminated an image of a police report related to one of these cases on the social network X, which initiated the investigation into a possible leak of confidential documentation.
In his testimony, Alfonso Serrano denied that the police document disseminated in January 2024 originated from the Alcalá de Henares City Council, asserting that he received it via email from an unknown address, along with a link to a news article. According to his version, no one from the Consistory contacted him about this matter, and he published it personally on his X account.
However, the Provincial Court of Madrid, in a resolution also advanced by the same media outlet, suggests that the mayor might have sent the image of the police report to Serrano, either directly or through the City Council's Communications Director. The Court emphasizes that the crime would have been consummated at the moment the document was transmitted, with its subsequent publication on social networks being a later phase of the events.
