Madrid Provincial Court Delays 'ITV Case' Trial in Móstoles

The judicial decision returns the file to the investigating court to secure economic liabilities before setting a date for the oral trial.

The Madrid Provincial Court has decided to return the separate civil liability section of the so-called 'ITV case' to the Móstoles Court, a resolution that delays the setting of a date for the oral trial.

The court demands that, before proceeding to trial, the processing related to potential economic liabilities arising from the procedure be completed. This means the investigating court must verify whether the accused have guaranteed the claimed amounts and, if not, may take measures such as requiring bonds or seizing sufficient assets.
So far, only the company ITV Móstoles S.L. has reportedly presented assets to cover the claimed civil liability, while the other investigated parties have not provided any guarantees or bonds.

In the order for the opening of the oral trial, the Investigating Court required the accused to jointly and severally provide a bond of 817,453.94 euros. This is the amount claimed by the Móstoles City Council in its indictment to guarantee eventual economic compensation.
The Seventh Section of the Madrid Provincial Court, responsible for the trial, had already received the documents sent from the investigating court. However, the magistrates deemed it necessary for this separate section to be fully resolved before proceeding with the pre-trial formalities.
The 'ITV Móstoles case' has been under judicial investigation for over four years. The procedure was referred in March to the Provincial Court for trial by the Investigating Section of the Móstoles Court of Instance.
The investigation focuses on determining whether there was harm to municipal coffers when the municipal government decided to condone a debt to the company ITV Móstoles S.L., responsible for vehicle technical inspections. On July 31, 2024, an order was issued for the opening of an oral trial for crimes of embezzlement and prevarication.
The popular prosecution, exercised by former councilors of a political party, requests six years in prison and fifteen years of absolute disqualification for the accused. For the accused company, ITV Móstoles S.L., the popular prosecution requests it be tried for embezzlement of public funds and seeks a sentence of three years and six months in prison, with a daily fine of 5,000 euros.
