The Getafe City Council has technically and legally demonstrated that the responsibility for conditioning Eduardo Torroja street lies entirely with the municipality of Leganés. This was stated during a working meeting between the mayoress of Getafe, Sara Hernández, and the mayor of Leganés, Miguel Ángel Recuenco, held in the El Bercial neighborhood.
Sara Hernández explained that "the technical and urban planning reports are clear and certify that the obligation to build and maintain this sidewalk rests exclusively with Leganés. The law obliges them to do so". She added that, "even though it is their responsibility, from Getafe we are willing to collaborate and lend a hand to find a joint and definitive solution for its urgent repair", prioritizing the safety of residents.
The documentation presented includes the delimitation made by the General Urban Planning Plans (PGOU) of both municipalities and the development regulations for the El Bercial neighborhood. Projects such as the IES Elisa Soriano of the Comunidad de Madrid or the new municipal swimming pool of El Bercial extend to Getafe's municipal limit, leaving the sidewalk area pending construction free. The Leganés City Council has not filed any objections to this regulation.
Added to the urban planning basis is the national and regional accessibility regulation, which legally obliges the administration of Leganés to provide the missing sidewalk within its municipal term and to carry out maintenance work to ensure safe routes for pedestrians and drivers.
Getafe's stance has always been the same, based on Leganés' obligation to provide the sidewalk. The previous Municipal Government of the Popular Party also demanded similar actions from Leganés.
The urgency of these actions is aggravated by the daily use of the road by residents and workers. In the immediate vicinity are the Seseña y Benavente school, IES Elisa Soriano, the Rafael Vargas sports pavilion, the El Bercial Health Center, and the future municipal swimming pool. On the Leganés side, a significant commercial area and a gym receive a large number of people daily, as well as the headquarters of various companies.
Getafe has reported three main problems, supported by reports from the Local Police and the Getafe Maintenance Unit. The first critical point is the pedestrian crossing connecting Avenida de México with Eduardo Torroja street, which leads to an inaccessible low wall and lacks a sidewalk on the Leganés side, forcing pedestrians to walk on the road.
The second major problem is the complete absence of a sidewalk in the section between Avenida del Parque and the aforementioned pedestrian crossing on Avenida de México, leaving pedestrians in a situation of extreme vulnerability. Finally, Getafe reiterates the need for maintenance of the section between Avenida del Parque and Bélgica street, where broken tiles and potholes constitute an insurmountable architectural barrier.
