A popular jury has unanimously found a man guilty of murdering his partner in Getafe in November 2023, ruling out psychological mitigating factors.

A popular jury of the Provincial Court of Madrid has unanimously found a defendant guilty of murder for killing his partner in November 2023 on a street in Getafe. The court dismissed the application of mitigating factors due to psychological alteration, considering that there was prior planning of the crime.
However, the jury acquitted the second defendant, who was on trial as a co-conspirator, for disabling two security cameras in the victim's building. It was not proven that the main defendant suffered from a psychological alteration that, combined with the consumption of alcohol and drugs, severely altered his cognitive and volitional capacities at the time of the events.
The prosecution is seeking a 30-year prison sentence for the main defendant, accusing him of home invasion, mistreatment within gender violence, and murder. The defense, on the other hand, argued that the defendant suffers from schizophrenia and requested that the acts be considered manslaughter with mitigating factors of reparation of damage and psychological alteration, asking for a five-year sentence.

He is unanimously considered guilty of the crime of murder, ruling out the application of mitigating factors for psychological alteration.

The Public Ministry maintains that the defendant acted motivated by his refusal to accept the romantic breakup with the victim and claims that he planned the crime after failing in his attempts to resume the relationship.
