The Provincial Court of Madrid has upheld the 35-year prison sentence for each of the three defendants accused of the murder of Krysthan Jesse Z. F., known as 'Bori', a 19-year-old who was fatally shot in Alcorcón in October 2022. The events took place following a chase near the Diverso nightclub.
The court considers the three defendants responsible for a completed murder offense, two attempted murder offenses, and an illegal firearms possession offense. The penalty includes 16 years for the completed murder, nine years for each of the attempted murders, and one additional year for the illegal possession of the weapon used.
According to the ruling, the convicted individuals acted jointly and coordinatedly after a prior fight at the nightclub. They then drove to the victim's residence area and pursued 'Bori' and two other individuals. Despite their attempts to flee, they fired shots, with one bullet hitting the victim in the shoulder. When he was already wounded and defenseless, he received a fatal shot to the head. The other two individuals managed to escape unharmed.
The verdict of the Jury Court was based on statements from witnesses, neighbors, and surviving victims, in addition to numerous expert and documentary pieces of evidence. These included biological and DNA analyses, studies of bloodstains found at the scene and in the vehicle used by the defendants, phone location reports, and ballistics tests, which allowed for the reconstruction of events and the placement of the three defendants at both the prior fight and the crime scene.
The sentence recognizes the aggravating circumstance of treachery (alevosía) for both the completed murder and the two attempted murders. According to the court, the defendants fired at unarmed individuals who were fleeing and trying to save themselves, eliminating any possibility of defense. Regarding the deceased victim, the sentence emphasizes that the final shot occurred when the young man was already wounded and completely defenseless.
Furthermore, the magistrates found it proven that the three convicted individuals jointly possessed the semi-automatic pistol used in the attack without the corresponding administrative authorization. However, the Provincial Court applied the mitigating circumstance of undue delay due to the accumulated delay in holding the trial, which extended for nearly a year due to circumstances beyond the defendants' control, who remained in provisional detention during the proceedings.
