Delicias residents appeal ruling allowing Tierno Galván auditorium privatization

The Delicias para Todos Neighborhood Association has filed an appeal with the Superior Court of Justice of Madrid (TSJM) against the ruling that rejected their challenge to the municipal decree.

The legal battle between the residents of the Delicias neighborhood and the Madrid City Council over the use of the Enrique Tierno Galván park auditorium continues. The neighborhood entity Delicias para Todos has lodged an appeal with the Superior Court of Justice of Madrid (TSJM). This appeal is directed against the sentence issued on May 20th by the Contentious-Administrative Court number 29 of Madrid, which dismissed the residents' challenge to the municipal decree regulating events in this space in the Arganzuela district.
The neighborhood association argues that the judicial resolution does not adequately address the complex legal and urban planning issues raised. They maintain that the debate over the use of public green spaces for private, profit-making events remains fully open. They contend that the decree approved by the Arganzuela district, which sets the conditions for the amphitheater's use, should not be considered a mere administrative act but rather a general provision that permanently establishes the future usage regime for the space and its surroundings.
According to the appellants, this regulation, by creating new obligations and setting binding criteria for future authorizations, should have undergone a specific approval procedure and been presented to the municipal plenary session. The neighborhood organization believes this case goes beyond the specific conflict over the auditorium, raising relevant questions about the management of public urban spaces and the need to preserve the green zone character of Tierno Galván park.
Furthermore, the association demands that residents' right to use and enjoy public spaces should take precedence over their commercial exploitation. From Delicias para Todos, they clarify that they do not oppose the occasional celebration of public, free-access cultural activities in the park. However, they criticize the generic invocation of general or cultural interest to justify the repeated holding of private and commercial events in a space designed for rest, recreation, and neighborhood coexistence. The association frames this conflict within a broader debate about the city's model, reflecting a shared concern among neighborhood groups about the increasing commercialization of public space and urban green areas.
