The sentence also imposes a restraining order and communication ban for twenty years, as well as compensation of 57,311.91 euros for the injuries and lasting effects caused. The court concluded that the accused acted with homicidal intent when he attacked the victim with a nine-centimeter blade knife, causing multiple wounds in vital areas of the body.

The ruling highlights that death was not caused by circumstances beyond the aggressor's control, including the woman's escape, the intervention of a neighbor, and the rapid medical assistance received. The accused and the victim had been in a nascent relationship for approximately one or two months, without stable cohabitation.

On the morning of June 12, 2022, they had an argument at the woman's home, after which the man left the residence. Shortly after, the victim called him to demand money he owed her, which is why the accused returned. Once inside the home, they both went to the kitchen. It was then that the accused took a knife from his backpack and, suddenly, turned towards the woman and began to stab her.

The sentence describes an attack of extraordinary violence. The convicted man delivered several stab wounds to the abdomen and, despite the victim's pleas to stop, continued attacking her in different parts of the body. In total, he caused injuries to the abdomen, neck, both arms, chest, and back.

When the woman tried to escape the residence to safety, the aggressor pursued her through the common areas of the building. Before she could take refuge in the elevator, he stabbed her again in the back. The victim finally managed to descend to the ground floor, where the accused waited for her and tried to prevent her from leaving the elevator. The assault only ceased when a neighbor, alerted by the cries for help, warned the aggressor that she had called the police.

After leaving the scene, the accused attempted to hinder his identification and connection to the events. He changed his clothes, discarded the garments he wore during the assault, and disposed of the knife used and a wallet belonging to the victim at various points along his route. He was eventually arrested by Local Police officers about two hundred meters from the scene.

The stab wounds affected particularly sensitive and vital areas. Among other injuries, the woman suffered penetrating wounds that reached the liver, spleen, and kidney, as well as multiple cuts to the neck, chest, back, and upper extremities. Medical reports confirmed that several wounds compromised vital organs and that the victim could have died if she had not received urgent medical assistance.

The victim had to undergo two surgical interventions, remained in the Intensive Care Unit, and subsequently required hospitalization, immobilization of her upper limbs, and prolonged rehabilitation. The healing process lasted 328 days. Permanent consequences include numerous scars, functional limitations in several fingers of both hands, persistent pain, moderate aesthetic damage, and post-traumatic stress disorder.

In light of these facts, the magistrates consider that there was a clear intent to kill. To reach this conclusion, they evaluated various elements: the weapon used, the repetition of the stabbings, the body areas attacked, and the objective severity of the injuries. The court emphasizes that the knife used was an instrument capable of causing death and that the attacks were directed at particularly vulnerable areas of the human body. Furthermore, the number of stab wounds and the persistence of the assault unequivocally reveal the intention to end the victim's life. However, as death did not ultimately occur, the conduct is punished as attempted murder.

The Court recognizes the presence of treachery, one of the elements that transforms homicide into murder. The magistrates reason that the victim could not foresee the attack. She had voluntarily allowed the accused into her home to discuss a financial debt and was unaware that he was carrying a knife. The assault occurred suddenly and by surprise; the accused removed the weapon when the woman did not expect it and immediately began stabbing her, eliminating any possibility of defense and ensuring the attack without risk to the aggressor.

The Court also recognizes cruelty, understanding that the accused deliberately and unnecessarily increased the victim's suffering. The sentence highlights that the man inflicted a total of 21 stab wounds, continuing to attack when the woman was already severely injured and even during her escape, which consciously increased the victim's pain and suffering.

The ruling states that, far from ceasing his actions, the accused continued inflicting wounds on different parts of the body and subsequently pursued her through the building when she tried to escape. For the Court, this behavior exceeded any necessary action to cause death and represented a conscious increase in the victim's pain and suffering. An appeal against the sentence can be filed with the Civil and Criminal Chamber of the Superior Court of Justice of Madrid.
