The court considers the accused the perpetrator of a homicide offense with the kinship aggravating factor. The sentence, issued after a guilty verdict by a popular jury, acquits the man of other charges such as reckless driving, driving under the influence of drugs, injuries, and habitual mistreatment.
The events occurred on September 2, 2024, in Madrid. Following an argument at their shared residence, the victim followed the accused to the street. According to the jury, the woman first positioned herself in front of the car, even climbing onto the hood, and later clung to the side of the vehicle as it moved.
The jury determined that the accused was aware the woman remained clinging to the car. Despite this, he continued driving, performed erratic maneuvers, partially entered the sidewalk, and braked sharply, causing the victim to be thrown off and suffer severe head trauma. She died the following day in the hospital.
The court finds that the accused acted with eventual intent (dolo eventual), accepting the extreme risk to the victim's life. In addition to the prison term, he is prohibited from approaching or communicating with the victim's children for twenty years, faces ten years of supervised release after serving his sentence, and the vehicle used in the incident will be confiscated.
The ruling allows for the possibility of substituting the sentence with expulsion from national territory, with a ten-year ban on re-entry, upon accessing the third penitentiary degree or conditional release. The resolution is not final and can be appealed.
