Aranjuez Urges Convocation of Martinsa-Fadesa Case Follow-up Commission

The Independent Citizen Group for Aranjuez (acipa) has urged the convocation of the Martinsa-Fadesa case follow-up commission in September to evaluate the insolvency proceedings and pending legal actions.

The Independent Citizen Group for Aranjuez (acipa) has presented a proposal to the Corporation's Plenary Session requesting the convocation of the follow-up commission for the litigation with Martinsa-Fadesa for the upcoming September. The objective is to ascertain the current status of the developer's insolvency liquidation process, the consequences of recent judicial rulings, and the forecasts for future legal actions, with the advice of the Aranjuez City Council's legal services.
This request arises from the delay in establishing this commission, which was unanimously approved in February 2025. acipa regrets that a tool beneficial to the entire Corporation, which would allow for understanding and contributing to the stalled Martinsa-Fadesa process, has been inexplicably delayed. The group has consulted its technical services but emphasizes the importance of shared knowledge of these issues, especially given a municipal claim exceeding 40 million euros against a developer in liquidation for over a decade.
The text recalls the background of the La Montaña neighborhood, whose urbanization was the obligation of the UTE Gran Casino Real de Aranjuez S.A. after being granted the concession for the second casino in the Community of Madrid in 2001. Despite the approval of the urban planning agreement in 2004, there were neglects in infrastructure construction and deficiency remediation, leading to the denial of final reception in 2008 and 2009. At that time, pending works were valued at nearly 40 million euros.
Since 2009, actions have been carried out using the guarantees provided by Fadesa Inmobiliaria S.A. to ensure the urbanization works. In 2015, the provisional liquidation of internal and external urbanization works amounted to over 36 million euros. Subsequently, in 2018, the Plenary Session approved the repair and completion project for the northern part of the sector, with a total cost of 14.3 million euros, partly financed by the executed guarantees.
In June 2021, the provisional quantification of costs for the supply and maintenance of basic services provided in La Montaña was approved, amounting to approximately 13 million euros. In case of non-voluntary payment, these would be claimed within the insolvency liquidation.
The Provincial Court of A Coruña, in 2017, partially classified nearly 24 million euros from the 2015 provisional liquidation as "insolvency credits." The golf course, one of the disposable assets, was finally awarded for 600,000 euros after several auctions, significantly below its starting price.
acipa criticizes the slowness of justice and the stagnation of the process, attributing it to dilatory maneuvers by the company in liquidation to avoid payments. They point out that, despite the profitability of the Aranjuez (La Montaña) project according to provisional reports, the City Council had to provide services and guarantees due to the developer's breach of the basic services agreement.
In light of this situation, the group requests the City Council to convene the follow-up commission in September to address the status of the process, the consequences of judicial rulings, and future legal actions, with the participation of the municipal legal services.
